Armed Forces Administrative Separations Board

Before going to a hearing with a separation board, an individual must know what to expect. Winning a case is not simple, so being prepared is the only way to approach an armed forces administrative separation board. The single method for winning is to convince the board that their discharge was either "inequitable" or "improper." For a discharge allegation to be inequitable, the reason or characterization of the discharge must not be consistent with the policies and traditions of the service. Improper, on the other hand, means that the reason or characterization of the discharge is in error. Persuading the five member of an administrative separation board can be much more difficult than most military personnel think. As a result, military legal help is often requested in order to assist with this difficult situation.

Handling Air Force Administrative Separation Board

When dealing with a separation board, a service member must know their rights. Any military personnel are able to call witnesses before a board such as the Air Force administrative separation board. These witnesses generally refute evidence presented by the separation authority. Additionally, female or minority soldiers may request in writing before the hearing begins that one of the board members also be a female or of the same minority group. If a member of the same minority group is not available, a member of a different group will be assigned instead. Knowing tips like these will ensure that the defendant is fully prepared to face an armed forces administrative separation board.

Options for Military Legal Help

Although a military lawyer will be provided free of charge for military personnel facing a separation, this is not always the best option. Many individuals in this situation will opt to hire their own civilian military legal help. These individuals will be assured that the appropriate civilian lawyer will be trained to help them in this specific situation. Considering this option will only be to the individual's advantage when facing a board such as the Air Force administrative separation board.
